These Loyalty Rewards Program Terms and Conditions (the "Program Terms") govern your participation in the Seacret Loyalty Rewards program (the "Program") operated by DeadSea.com LLC d/b/a Seacret ("Seacret", "we", "us", or "our") on the U.S. website located at www.seacret.com (the "Site"). The Program is provided in the United States only and is powered by a third-party loyalty platform (Yotpo Ltd.).
IMPORTANT: By enrolling in, participating in, earning Points in, or redeeming rewards through the Program, you accept and agree to be bound by these Program Terms, our Terms of Service, and our Privacy Policy. If you do not agree, do not enroll in or use the Program.
SECTION 15 CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER that affect your legal rights. Please read them carefully.
1. Eligibility
•    Age and residency. The Program is open only to individuals who (a) are legal residents of the fifty (50) United States or the District of Columbia, (b) are at least eighteen (18) years of age (or the age of majority in their state of residence, whichever is greater), and (c) have a valid U.S. shipping address and a registered account on the Site.
•    Personal, non-commercial use. Membership is personal to you. The Program is intended for individual consumers only. Businesses, resellers, distributors, wholesalers, dropshippers, professional accounts, and other commercial buyers are not eligible to participate, earn, or redeem Points on business or wholesale purchases.
•    One account per person. Each member may hold only one (1) active Program account, tied to a single verified email address. Duplicate, fraudulent, or automated accounts may be merged, suspended, or terminated at our sole discretion.
•    Void where prohibited. Participation is void where restricted or prohibited by applicable federal, state, or local law.
•    Employees. Employees, officers, contractors, and their immediate household members of Seacret and its affiliates may participate as consumers but are not eligible for referral bonuses on transactions involving other employees or affiliates.
2. Enrollment and Membership
•    How to enroll. You may enroll by creating an account on the Site, opting into the Program on the Loyalty Rewards page, or by taking any action that Seacret designates as an enrollment action (for example, verifying your email through Shopify customer accounts and clicking the opt-in confirmation on the Program page). Enrollment constitutes your acceptance of these Program Terms.
•    Welcome gift. Members who complete enrollment will receive one hundred (100) welcome Points, credited to their account after email verification. The welcome bonus is limited to one per person and per household and may not be combined with prior welcome bonuses. Seacret reserves the right to modify or withdraw the welcome bonus at any time.
•    Account accuracy. You are responsible for providing and maintaining accurate registration information (including your legal name, email address, and shipping address) and for keeping your login credentials secure. Seacret is not responsible for lost, misdirected, or unredeemable Points caused by inaccurate or outdated information.
•    Right to refuse. Seacret reserves the right, in its sole discretion, to refuse enrollment, deny Program benefits, or terminate any account it believes has been opened or is being used in violation of these Program Terms.
3. Earning Points
3.1 Base earn rate. Members earn Loyalty Points ("Points") based on Qualifying Spend on the Site. "Qualifying Spend" means the pre-tax, post-discount U.S. dollar amount actually paid by the member for eligible products, excluding shipping, handling, taxes, gift cards, subscription fees, and any amount paid using Points, store credit, or refunds.
3.2 VIP tiers. Members are placed in a VIP tier based on Qualifying Spend during a rolling twelve (12) month period. Tier status is re-evaluated on an ongoing basis. Points earn rates by tier are set out below.

•    Tier upgrades. Upgrades take effect within a reasonable period after the qualifying transaction is completed and cleared.
•    Tier downgrades. If a member fails to maintain the required Qualifying Spend during any rolling twelve (12) month period, the member will be downgraded to the applicable lower tier at the next tier evaluation. Downgrades do not forfeit already-earned Points, but future earn rates and tier-specific benefits will reflect the new tier.
•    Additional earning activities. Seacret may, from time to time, offer bonus Points for actions such as birthday, referrals, product reviews, social follows, account milestones, or promotional campaigns. Availability, Point values, frequency caps, and eligibility of each activity are shown in the Loyalty Rewards page or the applicable campaign and may be added, changed, or removed at any time.
•    Ineligible purchases. Points are not earned on: (i) taxes, shipping, handling, or duties; (ii) gift card purchases; (iii) subscription fees or memberships; (iv) purchases made using Points, store credit, or refunded amounts; (v) wholesale, business-to-business, or distributor orders; (vi) purchases later canceled, refunded, or charged back; and (vii) any other categories designated by Seacret from time to time.
•    Adjustments and reversals. If an order is returned, refunded, canceled, or subject to a chargeback, the corresponding Points will be reversed. If the reversal creates a negative Point balance, the member must earn additional Points to bring the balance to zero before redeeming.
•    Missing points. If Points do not appear in your account within thirty (30) days of a qualifying transaction, contact us at support@seacret.com with your order number. Missing-Point claims must be submitted within ninety (90) days of the original transaction.
4. Refer-a-Friend
•    How it works. Existing members may share a personal referral link with individuals who are not existing Seacret customers ("Friends"). When a Friend uses the referral link to complete a first qualifying purchase of $100 USD or more (pre-tax, post-discount, excluding shipping), the Friend receives a one-time 20% discount and the referring member receives 150 Points, credited after the referred order clears the return window.
•    Restrictions. Referral rewards are limited to genuine referrals of new customers. Self-referrals, referrals of existing or prior customers, referrals to accounts sharing a household or payment method, bulk or automated referrals, and referrals obtained through spam, misleading claims, unauthorized advertising, or paid search bidding on Seacret trademarks are prohibited and will be disqualified.
•    No cash value. Referral rewards have no cash value, are not transferable, and may not be combined with other offers unless expressly permitted.
•    Program limits. Seacret reserves the right to cap the number of referrals per member per calendar year and to modify or discontinue the referral program at any time.
5. Redeeming Points
•    Redemption value. Points may be redeemed at checkout on the Site at a rate of 10 Points = $1.00 USD discount (i.e., 100 Points = $10.00 USD), subject to any minimum redemption thresholds displayed at checkout.
•    Application. Point discounts are applied to the pre-tax product subtotal and may not be applied to taxes, shipping, handling, duties, gift cards, or subscription fees. Point redemptions do not themselves earn Points.
•    Stacking. Unless expressly stated, Point redemptions may not be combined with other promotional codes, sitewide discounts, or third-party offers. Where combination is permitted, the discount is applied in the order determined by the checkout system.
•    No cash value. Points and rewards have no cash value, are not legal tender, are not a stored-value or gift card, and cannot be redeemed for cash, exchanged, sold, or transferred, except as required by applicable law.
•    Refunds involving Points. If an order paid in part with Points is returned or refunded, the refund is issued first in Points (up to the number of Points originally applied), and then in the original tender for any remaining amount. Points refunded in this manner are subject to the same expiration rules as originally earned Points.
•    Availability. Specific rewards, redemption thresholds, and eligible products may be updated from time to time and are displayed on the Loyalty Rewards page. Rewards are subject to availability and may be substituted with a reward of equal or greater value at our discretion.
6. Point Expiration and Account Inactivity
•    Inactivity expiration. Points expire if a member's account is inactive for twelve (12) consecutive months. An account is considered "active" if the member (i) earns Points from a qualifying purchase or (ii) redeems Points during the period. Enrollment alone does not constitute activity.
•    Notice. Seacret will send at least one (1) email reminder to the member's registered email address prior to Point expiration where reasonably practicable. Members are responsible for maintaining a current email address in their account.
•    Effect of expiration. Expired Points are forfeited and cannot be reinstated except at Seacret's discretion. Points expiration does not, by itself, cancel Program membership.
•    Tier status. VIP tier status is separately evaluated on a rolling twelve (12) month basis, as described in Section 3.
•    State law. The expiration and forfeiture terms in this Section are intended to comply with applicable U.S. state consumer protection and unclaimed property laws. Where a state law provides a different or more protective rule for loyalty rewards, that state's rule will apply to members residing in that state.
7. Changes to the Program
•    Right to modify. Seacret reserves the right, in its sole discretion, to change, suspend, or discontinue any aspect of the Program at any time, including without limitation: earn rates, redemption values, VIP tier thresholds and benefits, referral rewards, birthday bonuses, eligible products, expiration rules, and these Program Terms.
•    Method of notice. Seacret will provide notice of material changes by (i) posting the updated Program Terms on the Loyalty Rewards page with a new "Last Updated" date, and (ii) where reasonably practicable, sending an email notice to the member's registered email address.
•    Notice period for material changes. For material adverse changes (defined as changes that reduce earn rates, increase redemption thresholds, shorten expiration periods, or eliminate an entire category of reward), Seacret will use reasonable efforts to provide at least thirty (30) days' advance notice before the change takes effect. Non-material or beneficial changes may be made immediately.
•    Acceptance. Continued participation in the Program after the effective date of any change constitutes your acceptance of the change. If you do not agree, your sole remedy is to cancel your Program membership under Section 8.
•    Program termination. If Seacret discontinues the Program in whole, members will be provided at least thirty (30) days' advance notice by email or on-site notice and a reasonable opportunity to redeem their then-current Point balance in accordance with these Program Terms.
8. Cancellation and Termination
•    By the member. You may cancel your Program membership at any time by contacting Seacret customer service. Upon cancellation, all unredeemed Points, tier status, and Program benefits will be forfeited.
•    By Seacret. Seacret may suspend or terminate any member's participation, forfeit accrued Points, and revoke tier benefits at any time, with or without notice, if it reasonably believes that the member has: (i) violated these Program Terms, our Terms of Service, or any applicable law; (ii) engaged in fraud, abuse, misrepresentation, or manipulation of the Program (including through automated activity, chargebacks, or coordinated referrals); (iii) resold, transferred, or attempted to monetize Points or rewards; (iv) engaged in abusive, threatening, or unlawful conduct toward Seacret personnel or customers; or (v) submitted an excessive volume of returns.
•    Effect. Sections 9-16 will survive termination of your Program membership.
9. Fraud, Abuse, and Compliance
Points and rewards are provided as a promotional incentive. Any attempt to obtain Points or rewards through fraud, misrepresentation, deception, or exploitation of a system error is strictly prohibited and may result in immediate forfeiture of all Points, termination of Program membership, cancellation of pending orders, and other remedies available under applicable law. Seacret's determination of what constitutes fraud or abuse is final.
10. Taxes
Members are solely responsible for any federal, state, or local taxes that may result from the receipt or use of Points or rewards. Seacret does not provide tax advice. Where required by law, Seacret may report the value of certain rewards to tax authorities and issue applicable tax forms.
11. Third-Party Loyalty Platform
The Program is powered by Yotpo Ltd. and its affiliates ("Yotpo"), which provide the technology used to track enrollment, Points, tiers, and redemptions. Yotpo is a service provider to Seacret and is not the sponsor of the Program. Your relationship with respect to the Program is with Seacret. Yotpo's processing of your personal data is governed by our Privacy Policy and Yotpo's applicable data processing terms.
12. Privacy
Seacret's collection, use, and sharing of your personal information in connection with the Program is described in our Privacy Policy. Residents of California, Colorado, Connecticut, Virginia, Utah, Texas, and other states with applicable consumer privacy laws have specific rights described in the Privacy Policy, including the right to know, access, correct, delete, and opt out of certain processing of their personal information. By enrolling in the Program, you consent to receive Program-related transactional communications (including Point balance updates, tier changes, expiration reminders, and Program updates). Marketing communications are sent only where separate consent has been obtained and may be unsubscribed at any time.
13. Communications and Consent
•    Transactional messages. As a Program member, you will receive transactional emails necessary to administer the Program (including welcome, Point accrual and redemption confirmations, tier change notices, expiration reminders, and material changes to these Program Terms).
•    Marketing messages. Marketing emails and, where applicable, SMS/MMS messages are sent only where you have provided separate, express opt-in consent in accordance with the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and applicable state law. Message and data rates may apply. You may opt out at any time by following the instructions in the message.
14. Disclaimers and Limitation of Liability
DISCLAIMER. THE PROGRAM AND ALL POINTS, REWARDS, AND BENEFITS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. SEACRET DOES NOT WARRANT THAT THE PROGRAM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SEACRET, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS (INCLUDING YOTPO) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SEACRET'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PROGRAM WILL NOT EXCEED THE GREATER OF (A) THE U.S. DOLLAR VALUE OF THE UNREDEEMED POINTS IN THE MEMBER'S ACCOUNT AT THE TIME OF THE EVENT GIVING RISE TO THE CLAIM, CALCULATED AT THE THEN-CURRENT REDEMPTION RATE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some U.S. jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the above limitations apply to the maximum extent permitted by law.
15. Governing Law, Arbitration, and Class Action Waiver
•    Governing law. These Program Terms and any dispute arising out of or relating to the Program are governed by the laws of the State of [INSERT GOVERNING STATE, e.g., Arizona], excluding its conflict-of-law rules, and applicable U.S. federal law.
•    Informal resolution. Before initiating any formal dispute, you agree to first contact Seacret at legal@seacret.com and attempt in good faith to resolve the dispute for at least sixty (60) days.
•    Binding arbitration. Any dispute, claim, or controversy arising out of or relating to the Program or these Program Terms that is not resolved informally will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in the county of your residence or another mutually agreed location. The arbitrator, and not any federal, state, or local court, has exclusive authority to resolve any dispute, except that either party may bring an individual action in small claims court.
•    Class action waiver. YOU AND SEACRET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.
•    Opt-out. You may opt out of this arbitration agreement by sending written notice to legal@seacret.com within thirty (30) days after you first accept these Program Terms. Your notice must include your full name, mailing address, email address on file, and a clear statement that you wish to opt out of arbitration.
•    Severability. If the class action waiver is found to be unenforceable, then the entirety of this arbitration section will be null and void, but the remainder of these Program Terms will remain in effect.
16. Miscellaneous
•    Entire agreement. These Program Terms, together with the Terms of Service and Privacy Policy referenced above, constitute the entire agreement between you and Seacret regarding the Program and supersede all prior communications or agreements on the subject.
•    No waiver. Seacret's failure to enforce any provision of these Program Terms is not a waiver of that provision.
•    Severability. If any provision of these Program Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.
•    Assignment. You may not assign or transfer any of your rights or obligations under these Program Terms. Seacret may assign these Program Terms without restriction.
•    Language. These Program Terms are executed in English. Any translation is provided for convenience only; the English version controls in the event of any conflict.

 Appendix A. Compliance Notes (Internal - Remove Before Publishing)
This appendix is provided as an internal reference for the Seacret legal and compliance teams. It is not intended to be published on the Site.
A.1 Regulatory framework relied on in these Program Terms
•    FTC Act Section 5 (UDAP): material terms disclosed clearly and conspicuously; no misleading promotion; rewards delivered as promised.
•    State UDAP statutes (e.g., California CLRA and FAL, New York GBL Sections 349-350, Massachusetts Chapter 93A, Florida FDUTPA): mirrored FTC-style disclosures.
•    State unclaimed property laws: loyalty rewards are generally exempt when they lack cash value and are non-transferable; the Program Terms are drafted to preserve that exemption (no cash-out, non-transferable, promotional in nature).
•    New York General Business Law Section 520-e: not directly applicable (not a credit-card-linked program), but the 30-day notice standard for material changes is adopted as a best-practice benchmark.
•    FTC Negative Option Rule (Rule Concerning Recurring Subscriptions, effective 2025) and California ARL: relevant only if the Program is tied to Subscribe & Save; separate auto-renewal disclosures are required in that case and are not covered here.
•    FTC Endorsement Guides (16 CFR Part 255): relevant to any influencer/affiliate use of referral links; ensure #ad disclosures.
•    TCPA and CAN-SPAM: transactional vs. marketing communications separated in Section 13.
•    State consumer privacy laws (CCPA/CPRA, VCDPA, CPA, CTDPA, UCPA, TDPSA, and others): addressed via cross-reference to the Privacy Policy.
A.2 Fields to complete before publishing
•    Effective date and Last Updated date.
•    Governing state in Section 15 (recommend the state of Seacret's principal U.S. place of business).
•    U.S. mailing address in Section 17.
•    Confirm support and legal email addresses.
A.3 Recommended implementation checks
•    Link these Program Terms from the Loyalty Rewards page footer and from the Yotpo enrollment widget.
•    Add a clickwrap checkbox at enrollment: "I agree to the Seacret Loyalty Rewards Program Terms."
•    Configure Yotpo to log timestamp, IP, and terms version at each acceptance.
•    Send a welcome email that restates the key material terms and links to the full Program Terms.
•    Set up automated 60-day and 30-day inactivity reminder emails prior to Point expiration.
•    Confirm review by U.S.-licensed counsel before publication. This document is a compliance-oriented template, not legal advice.
